There is one economic problem that is seldom discussed in the media -the number of uncollected monetary judgments. This refers to any type of case where someone wins a judgment in court, but is not able to collect the payment. This is something that happens far more frequently than is generally known. The results of judgments are frequently reported -such as someone winning millions of dollars in a lawsuit. However, we never hear about whether the winner of such a case actually collects this judgment.

When you win a judgment in court, you are still confronted with the step of collecting your judgment. Ideally, the debtor simply hands over the money and you both can get on with your lives. In practice, things are often more complicated. Debtors may be unwilling or unable to pay what they owe you. In such cases, you will have to make some efforts to either collect on your own, hire help or perhaps sell your judgment. Let’s look at some of the main points to consider when you have won a judgment.

People who are awarded money judgments often find that collecting their money is the most difficult part of the process. When debtors don’t pay, it can be a frustrating experience. Yet before you attempt to collect the judgment yourself, you should be aware that the law places restrictions on what you can do in such cases.

In some ways, it’s harder than ever to “disappear” today without leaving traces. This can be good news if you are trying to find someone who owes you money -for example, if you’ve won a judgment against someone but they haven’t paid up. On the other hand, if your time and financial resources are limited, it can be challenging to track someone down. Winning a judgment in court can be a satisfying experience, but only if you actually collect on it. It’s an unfortunate statistic that about 80% of money judgments are never collected, due to a variety of reasons. The debtor may not have any money or assets or they may be difficult to track down.

For many people who are awarded money judgments, the victory in court is only the beginning of their long road towards actually receiving this money. In some cases, the debtor simply pays. This is, naturally, the preferred scenario. However, in the majority of cases, it’s more complicated. Judgments often have to be enforced in a variety of ways before the creditor can collect.

Judgment Marketplace has attracted quite a bit of attention in the media recently. First, a well publicized judgment against Kim Kardashian was put up for sale on the site. Then, the even more famous wrongful death judgment against O.J. Simpson was listed. Now, there is another piece of news that is making waves in the legal community as well as the mass media -the aforementioned judgment against Kim Kardashian has sold for $5,000.

The trial of O.J. Simpson was one of the biggest stories of the 1990s. As most people know, Simpson was ultimately acquitted in a decision that remains highly controversial. Two years later, Sharon Rufo, the mother of murder victim Ron Goldman won a wrongful death judgment against Simpson for $9 million, which was seen as something of a vindication for the victims. Simpson, of course, ended up getting convicted for another crime -a 2007 armed robbery of sports memorabilia in Las Vegas. He has been in a Nevada prison since 2008. But what about the judgment? As it turns out, it was never paid.

Perhaps, like many people, you were awarded a judgment after an accident, dishonest transaction or case of negligence on the part of someone else. You probably felt a sense of relief and vindication after winning your case. While the aware cannot undo whatever wrong you suffered, it could at least make things a little easier for you and your loved ones. Not only that, but it’s always a good feeling to have the legal system come down on your side and publicly declare that you were in the right.

Sometimes even the wealthiest people don’t pay their bills. A case in point is Kim Kardashian, who seems to be featured in at least a few news stories every week. With an estimated net worth of around $40 million, you might think that Kim would be able to pay her dental bills. Apparently, however, she is too cheap, stubborn or maybe just distracted to take the time for such trivial matters.

Every year, millions of lawsuits are filed in the United States. This results in many judgments, ranging from trivial amounts to many millions of dollars. What many people don’t realize, however, is that many judgments are never collected. In fact, as many as 80% of judgments remain uncollected by the “winners” of these cases.
